Terms of Service

1.Agreement to These Terms

These Terms of Service (“Terms”) are a legal agreement between you and Ace's Gun Dog Kennels LLC, doing business as Global Retriever Solutions (“GRS,” “we,” “us,” or “our”). They cover your use of www.globalretrieversolutions.com, the member and trainer dashboards, our training videos and written materials, the community, and related services (together, the “Services”).

By creating an account, buying a membership, or using the Services, you agree to these Terms, our Refund & Cancellation Policy at https://www.globalretrieversolutions.com/refund-policy, and our Privacy Policy at https://www.globalretrieversolutions.com/privacy. If you do not agree, please do not use the Services.

Please read Section 16 carefully. It requires most disputes to be resolved by individual arbitration and waives class actions and jury trials.

2.Who Can Use GRS

You must be at least 18 years old and able to enter a binding contract to create an account or buy a membership. By using the Services you confirm that you meet these requirements and that the information you give us is accurate.

3.Your Account

• One person per account: each account and membership is for one individual. You may not share your login, let anyone else use your account, or use one account for a group, club, kennel, or business.
• Keep it secure: you are responsible for keeping your password private and for everything that happens under your account. Tell us right away at globalrs2024@gmail.com if you think someone else has accessed it.
• Keep it accurate: keep your name, email, and billing details up to date.

We may watch for signs of shared accounts (for example, many devices or locations using one login at the same time) as described in our Privacy Policy.

4.Memberships, Billing, and Renewal

• Billing terms: memberships are sold monthly, for 1 year (pay for 11 months, get 1 month free), or for 2 years (pay for 20 months, get 4 months free). The free months are applied as a lower total price for the term.
• Prices: current prices and what each plan includes are shown on our pricing page and at checkout. Prices are in U.S. dollars, plus any applicable taxes shown at checkout.
• Payment: all payments are processed by Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method for each term.
• Automatic renewal: your membership renews automatically at the end of each term for a term of the same length, at the price then in effect, until you cancel. You can cancel at any time in Settings, then Billing.
• Price changes: if the price of your plan changes, we will email you before your next renewal. If you do not want to pay the new price, cancel before your renewal date.
• Failed payments: if a payment fails, we may retry it and may pause or end your access until it is paid.
• Promotions and discounts: discounts, promotional prices, and referral discounts apply only as described when offered, have no cash value, and cannot be combined unless we say so.

5.Cancellations and Refunds

You can request a full refund of a new membership by emailing globalrs2024@gmail.com within 5 calendar days of your first payment. After that, you can still cancel at any time and keep access until the end of the term you paid for, but payments are not refunded. This applies to 1-year and 2-year memberships too.

6.Referral Program

Members may earn rewards for referring new paying members, as described on the Refer & Save page in the member dashboard. Today, members with 5, 10, 15, or 20 active paying referrals receive 25%, 50%, 75%, or 100% off their own membership.

• Only real, paying members count: a referral counts while the referred person has an active, paid membership. If a referred member cancels, is refunded, or charges back, they stop counting, and your discount is adjusted at your next billing.
• No self-referrals or fake accounts: referring yourself, a second account of your own, or made-up accounts is not allowed. We may cancel rewards earned this way and suspend the accounts involved.
• No cash value: referral discounts and rewards cannot be exchanged for cash or transferred.
• Changes: we may change or end the referral program at any time. Discounts already applied to a paid term will not be taken back because of a change.

Trainers who earn commission on referrals do so under separate terms agreed with us. If those terms conflict with this Section, those terms apply.

7.Our Content and Your License

All training videos, lessons, written materials, quizzes, images, logos, and other content on the Services belong to GRS, our trainers, or our licensors and are protected by copyright and other laws.

While your membership is active, we give you a personal, non-transferable, non-exclusive license to stream and view the content you have access to, for training your own dogs. You may not:

• Download, screen-record, copy, or save videos or materials, except where we offer a download feature;
• Share, post, upload, stream, or show our content anywhere outside the GRS platform, including social media, websites, group chats, or video sites;
• Sell, rent, license, or charge for our content, or use it to teach classes, run a training business, or create competing courses;
• Get around our security, video protection, or access controls, or use bots or scripts to access the Services.

8.Community Rules and Your Posts

Community rules

When you use the community, questions, comments, or any other shared area, you agree not to:

• Harass, threaten, insult, or bully anyone;
• Post hateful, sexual, violent, or illegal content, or content showing cruelty to animals;
• Spam, advertise, or promote other businesses, courses, or products without our permission;
• Post other people's private information or content you do not have the right to share;
• Impersonate anyone, including GRS staff or trainers;
• Give dangerous advice or encourage unsafe handling of dogs or firearms.

We may remove any post and limit or end access for anyone who breaks these rules.

Your posts and uploads

You keep ownership of the photos, videos, and text you post or upload. You give us a worldwide, royalty-free license to host, store, display, and share that content inside the GRS platform so the Services work, for example showing your community post to other members or your homework video to your connected trainer. This license ends when you delete the content or your account, except where others have already interacted with it or we need to keep it for legal reasons.

We will not use identifiable photos or video of you or your dog in public marketing outside the platform without your separate permission, as explained in our Privacy Policy. You confirm that you have the right to post what you upload.

9.Suspension and Termination

We may suspend or permanently ban your account, without notice and without a refund, if we reasonably believe you have:

• Shared your account or login with anyone else;
• Used, copied, or shared our content outside the GRS platform in breach of Section 7;
• Broken our community rules in Section 8;
• Committed fraud, abused the referral program, or filed a payment dispute in bad faith;
• Otherwise broken these Terms or the law.

You can stop using the Services at any time by cancelling your membership. Sections that by their nature should continue after your account ends (including Sections 7, 10 through 17, and 19) will continue.

10.Dog Training Risks

Dog training carries real risks, especially gun dog and retriever training, which can involve water, cold or hot weather, rough terrain, live or dead birds, training equipment, and firearms. Dogs can bite, injure people or other animals, get hurt, or get lost.

• Your responsibility: you are solely responsible for your dog, your own safety, the safety of others around you, and deciding whether a technique is right for your dog.
• Firearms and hunting: always follow firearm safety rules and all local, state, and national laws, including hunting seasons, licensing, and land-access rules.
• Your dog's health: check with a veterinarian before starting a new or demanding training program, and stop if your dog shows signs of injury, illness, or distress.
• At your own risk: you choose to use our training content voluntarily and at your own risk.

To the fullest extent the law allows, you accept these risks and release GRS, Ace's Gun Dog Kennels LLC, and our trainers from claims for injury, illness, death, or property damage arising from your use of our training content, except where caused by our gross negligence or willful misconduct.

11.No Guarantee of Results

Every dog and handler is different. Our content is educational and is not a substitute for in-person, professional, or veterinary help. We do not promise that your dog will reach any particular level, title, or behavior, and testimonials or examples are not a guarantee of your results.

12.Third-Party Services

The Services rely on third-party providers such as Stripe (payments), Mux (video), Supabase (accounts and data), Vercel (hosting), and Resend (email). Your use of those parts of the Services may also be subject to their terms. We are not responsible for third-party websites or content we link to.

13.Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR ALWAYS AVAILABLE, OR THAT ANY PARTICULAR COURSE OR LESSON WILL REMAIN AVAILABLE.

14.Limitation of Liability

TO THE FULLEST EXTENT THE LAW ALLOWS, GRS, ACE'S GUN DOG KENNELS LLC, AND OUR OWNERS, EMPLOYEES, AND TRAINERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM OR RELATED TO THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT BE MORE THAN THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM.

Some places do not allow certain limits on liability, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

15.Indemnity

To the extent the law allows, you agree to defend and hold harmless GRS, Ace's Gun Dog Kennels LLC, and our owners, employees, and trainers from claims, losses, and costs (including reasonable attorneys' fees) arising from your breach of these Terms, your posts or uploads, or your handling of your dog.

These Terms are governed by the laws of the State of Mississippi and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 16, any court proceeding will be brought in the state or federal courts located in Mississippi, and you and GRS consent to their jurisdiction.

18.Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will change, and we will tell members about material changes by email or with a notice in the member dashboard before they take effect. Continuing to use the Services after changes take effect means you accept the updated Terms. Changes will not apply to disputes that arose before the update.

19.General Terms

• Entire agreement: these Terms, the Refund & Cancellation Policy, and the Privacy Policy are the full agreement between you and GRS about the Services.
• Severability: if any part of these Terms is found unenforceable, the rest stays in effect.
• No waiver: if we do not enforce a part of these Terms, that does not mean we give up the right to enforce it later.
• Assignment: you may not transfer your account or these Terms. We may transfer them as part of a merger, sale, or reorganization of our business.
• Events outside our control: we are not responsible for delays or outages caused by events beyond our reasonable control, such as natural disasters, internet or power failures, or problems with our service providers.
